Defining Other Party Obligations
As a PCBU (Person Conducting a Business or Undertaking), both direct and upstream obligations and responsibilities apply; for example, the other party, in this case, the Hirer of a facility; must meet certain obligations, responsibilities and conditions, which must be acknowledged by way of a contract.
Whilst most PCBU’s specify each parties obligations and responsibilities via some form of written indenture, the risk of getting this wrong won’t come to the fore until an incident or law suit materialises. The ultimate question is: are you getting this right?
