Proving Compliance

The Work Health and Safety Act 2011 (WHS Act) obligates a person conducting a business or undertaking (PCBU), or duty holder, to provide evidence of:

  • Consultation and communication with employees regarding work health and safety matters pertaining to their workplace;
  • The risks and hazards identified within their workplace;
  • The mitigation strategies implemented by way of relevant policies and procedures;
  • The execution of these strategies and plans via substantiated training; and
  • Ongoing evaluation and monitoring of the records and documents or management system.

The legislation is intolerant to ignorance or financial arguments – failure to prove compliance can have a devastating impact, financially and personally, on the PCBU and the business.
